1. Introduction

Welcome to MBGuards ("the Service", "we", "us", "our"). MBGuards is a SaaS platform that provides passive security analysis, domain verification, AI-generated reports, and related features for website owners.

By using our Service, you agree to these Terms of Service ("Terms"). If you do not agree, you must stop using the Service immediately.

2. Eligibility

To use MBGuards, you must:

• Be at least 18 years old.
• Provide accurate registration information.
• Own or be authorized to manage any domain you submit to the platform.
• Comply with all applicable laws in your jurisdiction.

3. Domain Ownership Verification

Before scanning or registering a domain, you must prove ownership via DNS TXT verification:

• You must add a TXT record with the verification code provided by the Service.
• Only after successful validation may the domain be added to your account.
• You acknowledge that scanning domains you do not own is strictly prohibited.
• We reserve the right to revoke domain access if ownership cannot be confirmed or if abuse is suspected.

4. Permitted Use

You may use the Service only for:

• Monitoring the security posture of domains you own or manage
• Obtaining AI-generated insights
• Receiving alerts about public security misconfigurations
• Managing your subscription and domain data

5. Prohibited Use

You agree not to:

• Scan, test, or analyze domains you do not own or administer
• Engage in hacking, exploitation, fuzzing, brute-force attacks, or intrusive cyber operations
• Attempt to bypass domain verification
• Interfere with, overload, or disable the Service
• Use bots, automation, proxies, or scripts to abuse rate limits
• Reverse engineer or copy the Service for malicious use
• Upload or transmit malicious code

6. Nature of the Service

MBGuards performs passive, non-intrusive scans only.

We do NOT:

• Perform penetration testing
• Exploit vulnerabilities
• Conduct deep crawling
• Run intrusive scans
• Access your server backend or databases

Scan results are based solely on publicly available information.

7. AI-Generated Outputs

Some features use AI models (e.g., OpenRouter, LLMs) to:

• Interpret scan findings
• Generate reports
• Give recommendations

You understand and agree that:

• AI-generated content may be incomplete, inaccurate, or outdated
• It is for informational purposes only
• It does not constitute professional or legal advice
• You remain responsible for verifying all recommendations

8. Subscription and Payments

Payments are processed via Stripe. By subscribing, you agree to:

• Provide accurate payment details
• Authorize recurring charges
• Accept Stripe's own Terms of Service
• Understand that fees are non-refundable unless required by law

Plans may include limits on:

• Number of domains
• Scan frequency
• AI usage
• Features

We reserve the right to modify pricing with notice.

9. Termination

We may suspend or terminate your account if:

• You violate these Terms
• You engage in suspicious or abusive activity
• You attempt to analyze domains you do not own
• You misuse or attack the Service

Upon termination, your data may be deleted permanently.

10. Disclaimers

MBGuards is provided "as is" without warranties of any kind.

We do not guarantee:

• Complete vulnerability detection
• Uninterrupted uptime
• Perfect accuracy of AI outputs
• Prevention of cyber attacks
• Correctness of scan results
• Any specific security outcome

You acknowledge that:

• No security tool can detect all threats
• You are responsible for implementing security measures on your server
• We are not liable for damages resulting from reliance on our reports

11. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, punitive, or consequential damages
• Our total liability shall not exceed the amount paid in the last 12 months
• You use the Service at your own risk

If you are not satisfied with the Service, your remedy is to stop using it.

12. Privacy

Your use of the Service is also governed by our Privacy Policy.

13. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email or dashboard.
